I agree with your point that the City Council has far more power than they are willing to use. Working in conjunction with the health providers and the DA, enact a specific policy/ordinance for what can be done and what is prohibited. Then send that off to the State for review. The State can then accept it, suggest changes or reject it. The City can then decide to make changes or take it to Court. Either way, the local practitioners are covered by the local law until it is definitively overturned by the court or by legislative action. You generally can’t go back and prosecute or sue for acts that were in compliance with the law(s) in effect at the time.
